Service Tax Rule in India for Income from Online Advertisements and Affiliate Income from Blogger

Service Tax is a form of tax which is levied on any service and is to be paid by the “provider” of the service to the Central Govt. at the rates in force. The provider of the service can in turn collect the tax form the recipient of his service.
Starting July 1, 2012, India has shifted to the Negative List System which states that Service Tax would be levied on all services except the ones mentioned in the Negative List. Earlier, all services were exempt from Service Tax except those mentioned in the act.

The sale of advertising space or time slots is included under (G) Section 66D of Finance Act, 2012.

Service Tax on Income from Advertisements

The educational guide on Service Tax, released by the Indian Ministry of Finance on June 20, 2012, mentions (page 35) that Service Tax is to be levied on the sale of space or time for advertisement to be broadcasted on radio or television. However, the notification also states that service tax is not to be levied on sale of space in print media, bill boards, buildings, cell phones, ATM Machines & Internet.
As the new service tax regime has specifically stated that Service Tax is not chargeable on the sale of space for advertisements on the Internet, website owners and bloggers are exempted from paying Service Tax in India.
In case you have already paid Service Tax on online income from Google AdSense and other direct ad Sales, you can always claim refund of Service Tax.

Service Tax on Affiliate Income of Bloggers

The service tax is only exempted for advertising income but if you who are earning revenue though affiliate commissions (like Amazon Associates) or by providing other related services on the Internet, service Tax would be levied on all such services.
Moreover, service tax is levied on the Gross Amount Received rather than on the Net Income (i.e. Gross Amount – Expenses).
You can however claim Small Scale Service Provider exemption if the gross value of such services is less than Rs. 10 Lakhs. In other words, you are not required to pay any tax if the gross value of services provided by you is less than Rs. 10 Lakhs.

Microsoft : 100 innovation centers in India


CHENNAI: IT giant Microsoft has planned to establish 100 Microsoft Innovation Centres in the country over the next two years.

The innovation centres will act as "innovation hubs" at select colleges and technology institutes, providing incubation and expert hands-on support on Microsoft technology, research and software solutions, to create student technology experts, a company statement said.

As a first step, the company has signed MoU with academic institutes across four states to set up 75 such innovation centres. Microsoft aims to launch 100 Innovation Centres in the country over the next two years, it said.

The innovation centres will cover five lakh students country-wide, it said, adding about one lakh students will be certified on Microsoft technologies.

"The programme will also drive innovation and help build a product-based software economy by supporting product development and over 500 start-ups", it said.

The Innovation Centres would operate on a hub-and-spoke model. The first 14 innovation centres proposed to be set up are in Hyderabad, Vijayawada, Rajahmundry, Khammam, Bapatla, Guntur and Tirupati in Andhra Pradesh, Raipur in Chhattisgarh, Bhopal in Madhya Pradesh, Tiruchirappalli, Vellore, Coimbatore, Madurai and Salem in Tamil Nadu.

"The Microsoft Innovation Centres are designed to offer a unique environment conducive for student entrepreneurship. The Microsoft Innovation Centres can play a vital role in generating powerful new ideas through training, education and knowledge transfer", Microsoft India, General Manager (DPE), Joseph Landes said.

The announcement by Microsoft comes after the India launch of company's new initiative, YouthSpark, aimed at addressing the opportunity divide faced by the young people of the world, the statement added.

As many as 112 government websites, including those of Planning Commission, the Finance Ministry and various State government agencies, were hit by cyber attacks during a three-month period ending February 2012, reveals minister of state for communications and IT Sachin Pilot in the Lok Sabha.
The minister further revealed that the website of Bharat Sanchar Nigam Ltd (BSNL) was hacked on December 4, 2011 by a hacker group called 'H4tr!ck'. The websites of Finance, Health, Human Resource Development ministries and Planning Commission also suffered the cyber attacks. A number of state government websites, including those of Andhra Pradesh, Tamil Nadu, Kerala, Odisha, Uttar Pradesh, Sikkim, Manipur, Madhya Pradesh, Rajasthan, Maharashtra and Gujarat, came under attack.
Pilot also said that the Department of Information Technology and the National Informatics Centre (NIC) are working on upgrading their skills to handle threats from cyber attackers. The agencies are working on upgrading the Firewalls and new filters are being added to keep the hackers at bay.
The minister's revelation has not surprised much as the government sites have been long targeted by the hackers. The Defence Research and Development Organisation (DRDO) recently disclosed that the government sites were hacked almost 200 times during the Commonwealth Games in 2010. The DRDO also pointed out that more resources were required to control these cyber attacks in near future.

Google doodle celebrates Republic Day

NEW DELHI: As India celebrates its 63rd Republic Day on Thursday, popular search engine Google dedicated its latest doodle to this theme.

Internet users can see images of elephants and tri-coloured umbrellas decorating the word 'google' in the latest doodle. Three charming and joyful elephants denote the health of Indian culture and Indian economy. All three umbrellas contain saffron, white and green colour on them that gives the look and feel of the Indian flag. The 'O' of Google appear like the Ashoka's wheel.

Google regularly presents to the users colourful doodles to observe birth anniversaries of important personalities and significant dates. The Republic Day of India marks the anniversary of the adoption of the Constitution of India.
